Yes, Gardner was well within his rights to do so but it never would have happened if Gardner had used some common sense and some restraint. He allowed the situation to escalate to the point where he used his taser. Had Gardner been properly trained in how to handle people who do not want to sign a ticket, this situation would never have gotten out of control. All he had to do was give the man the citation and said "If you wish to contest this ticket, I'll see you in court. Have a nice day." Instead, he got into a tit for tat argument trying to settle the legality of the ticket in an improper place. Both Gardner and Massey were idiots that day.

1. No he was not well within his rights to use the taser on Mr. Massey.

2. Gardner did NOT have two people 'coming at him at the same time'. He had instructed Mr.Massey to exit the vehicle and step toward the rear of the vehicle.
Mrs. Massey didn't exit the vehicle until AFTER her husband had been tased, and she heard him scream and saw him go down. I can't say that I blame her one bit. Most wives would do the same.

3. Thank God that you are retired.

4. Considering the fact that a taser is not considered to be a 'non-lethal' weapon...but a 'less lethal' weapon...it is very fortunate indeed that Mr. Massey didn't die, and that his family weren't bereft of a husband, father and son just because a hot-headed officer didn't have better control of his temper.

I am real upset with cops who think they are above the law and taser who they want especially when people are just asking questions of why they were stoped or getting arrested!! On Friday 12/7/07 cops came to my dad's shop and told him he was getting arrested he just asked why he was getting arrested and the cop tasered him in the stomache and then my dad turned around and he tasered him in the heart which made my dad fall and hit his head real hard where it was bleeding the cop had to take my dad to the hospital. now my dads eye is all swollen and has a big gash on it and his arm is swollen to I know the cop was in the wrong doing. I believe cops who do stuff like that should be fired!!!!! that guy who got polled over had no right being tasered what is this world coming to. I hate cops with a passion.

It had more to do with ego than anything else. Even the traffic stop itself.

What? He was speeding. The stop was justified. The tazer, however, was overkill.
