Yes, Gardner was well within his rights to do so but it never would have happened if Gardner had used some common sense and some restraint. He allowed the situation to escalate to the point where he used his taser. Had Gardner been properly trained in how to handle people who do not want to sign a ticket, this situation would never have gotten out of control. All he had to do was give the man the citation and said "If you wish to contest this ticket, I'll see you in court. Have a nice day." Instead, he got into a tit for tat argument trying to settle the legality of the ticket in an improper place. Both Gardner and Massey were idiots that day.
