Your point, BrightEye, brings us to our point. . .Camping in the wilderness has its own "known complications" which this family, unfortunately, experienced. The Department of Wildlife, etc., didn't violate a standard of care.

As sad as I am about their loss how can someone sue a state that has never had a bear fatality, ever? I camped in California at Bear River. Trees showed signs of claw marks. In going into that camp site I was fully aware that bears were there first. I just don't know how anyone who camps in the wild or swims in the ocean doesn't factor in whose home it is. No one can 100 percent protect anyone from anything and yet as a society we seem to want unconditional protection for whatever we decide we want to do. My advice is to never camp in the wilderness or swim in the ocean if you expect complete protection.

Whether or not the family has a case is up to the courts. And you can only assume what the family is thinking and/or feeling. You do not know.

I can't even assume to know what you are thinking or feeling because I have no clue! I don't know you, have never met you, and can only wonder why you are so cynical and pessimistic . . . not to mention a lawyer hater Let me ask you a question, when a dentist advertises his practice to recruit new patients, is he the equililent to an ambulence chaser? How about an MD that advertises, or a car dealership? They are really trying to entice you to buy that new car you know you want but can't afford. There really are legitimate lawsuits, you know. Some day, you may find yourself in desperate need of representation, then maybe you will have to eat some humble pie.

Southern Girl...I am doing pretty good now...thank you for asking.

Bright Eye....so you are a brain surgeon now as well as an egotistical jerk???

It clearly shows on my MRI pictures that the bone that was cut out to access my tumor and then put back in with screws was put back in BACKWARDS!!!! IE...rounded part facing in instead of out. I asked the MRI technition about his several times on the second follow up MRI and he said thats exactly what it appeared to be and that's why it looked the way it did. So....do you still think I couldn't have prevailed in a suit against my surgeon??? But guess what??? He didn't cause my tumor and I would have DIED without his care and my life is no different now with things the way they are.

But I bet if some ambulance chaser heard this story he would love to come to my home or place of business and try to convince me that we could go after his malpractice insurance and get millions....of course with his cut of 50%!!!

And I also bet that is also what is going on in this situation too. Its been way to long since the attack happened for this to just happen. Some attorney has approached the family and convinced them that they need to sue.

Too bad your tumor was caught in time.

Most medical malpractice firms would NEVER take your case. It's not a good case. As you said, the surgery saved your life, and the doctor probably did as good of a job as he could.

And who are you calling an egotiscal jerk? You are the one that posted the despicable comment about how the bear should sue because he got indigestion from eating that kid.

How can you look at the pictures of that kid and his family and write shite like that. Do you have a heart, or was that removed during your brain tumor surgery as well?

You are really uneducated about how lawsuits work. It's against the law for an attorney to take 50% of a settlement. The reason attorneys work on contigency basis is that lawsuits (especially medical malpractice suits) are expensive. People usually can't afford to front the costs. If the case is kicked out, the lawyer gets nothing. Therefore, most lawyers won't take cases without merit because they will lose money.

The lawyers that make the money are the lawyers who work for the insurance companies. They are paid by the hour and they bill very high. They get paid no matter what.

I assume you are in the business of homes. As we know from news from the last year or so, you guys are NEVER greedy, and never screw people over.
