State denies responsibility for bear attack Print E-mail

PROVO, Utah -- In 4th Disrict Court papers, Utah officials say the blame for a bear attack that killed an 11-year-old Utah County boy lies in the hands of the federal government.

Lawyers for the attorney general's office say the Utah Governmental Immunity Act protects the state from liability.

Sam Ives was camping in American Fork canyon last June when a bear ripped through a tent and mauled him to death. In a lawsuit his family claims that state and federal agencies failed to warn campers that bears had been harassing campers in the same area a day earlier.

In 4th District Court papers in response to the family's claims, state attorneys conted the U.S. Forest Service is responsible -- along with Ives and his stepbrother Jack Mulvey, who the state contends negligently brought food, soda and other "bear attractants" to their campsite.

Allen K. Young, who represents the family, calls the state's response outrageous.

So the plot thickens. The State had the finger pointed at them as being responsible for the bear attack. The state denies responsibility and points the finger at the Federal Government and at the family of the young man for having brought food with them to the camp site.

I just hope that if I am ever killed by a random act of nature that everyone doesn't dishonor me by trying to make a buck off of my death.

Smokey, Yogi, Booboo, Fozzy, Bear (of the big blue house), Winnie, Teddy, Pappa, Mamma, Baby, Brother, and bears everywhere are trying to distance themselves from this egregious and self-serving act by one of their own.

"Why couldn't he have just swiped their pickanick basket like regular bears" lamented Yogi.

A depressed pooh bear could barely eek out the words "tut-tut"

Even the normally cheerful Fozzy was not inclined to jokes. "It's a crying shame when wildlife doesn't behave like we've come to expect on TV. I think the family should sue! I know just the guy!"
