Man gets jail time, second chance at treatment Print E-mail

A man convicted of climbing into a 17-year-old girl's bedroom and taking off all his clothes has been kicked out of his sex-offender treatment program, but will get a second chance after spending some time in jail.

On Wednesday, 4th District Judge Claudia Laycock sentenced 22-year-old Forrest Barth to spend 60 days in the Utah County Jail. Once he completes that sentence, he will return to the state-run Freemont Community Correctional Center for sex-offender treatment, a course of action recommended by Adult Probation and Parole. Barth's attorney, Tom Means, said the program usually lasts for at least a year, and would likely be longer for Barth upon his return because he had already been kicked out once.

Thanks in part to a plea from his victim's mother, Barth was able to avoid prison and was sentenced instead to the treatment center after spending time in jail. But he has been back in jail for about two weeks after getting kicked out of the Freemont Center for "acting out sexually," Laycock said at Wednesday's hearing. Barth will get a second chance at Freemont when he gets out of the Utah County Jail, but Laycock said that he may face prison time if he is kicked out again.

"They will have zero tolerance for any kind of acting out sexually a second time," Laycock said.

Barth admitted that he failed to complete the treatment program at Freemont. Laycock said the original sentence that she gave Barth was generous, and told him he was lucky to get a second chance.

"Be very, very careful. I'd like to see you succeed, Mr. Barth," she said. "Don't disappoint us."

Barth pleaded no contest last year to attempted unlawful sexual conduct with a 16- or 17-year-old. He was originally charged with attempted rape after he climbed into a 17-year-old girl's bedroom, stripped naked and got into her bed while she slept. He also pleaded guilty to attempted aggravated burglary and possession of a controlled substance.

Well he will get all the sex he wants once he hits the jail. Prisonpiggy and his bros will just turn their back when the thunder starts rolling (as they should).

That kid would have been dead had he come into our house. My girls rooms are way past the point of no return. If they were to come in the front door we have a hall way that if they proceeded past that we'd shoot them. But if someone were to climb into our girls windows he'd be dead.
