Ragsdale's sister denied right to represent him in court

Tamara Ragsdale may have power of attorney for her brother, David Ragsdale, but attorneys in the civil suit against him say that doesn't give her the right to represent him in court.
In a memorandum filed Monday, attorney Robert Jeffs asked the 4th District Court in Provo to strike Ragsdale's response to a wrongful death lawsuit. David Ragsdale is charged with aggravated murder in the January shooting death of his wife, Kristy, in a Lehi church parking lot. The response to the wrongful death lawsuit is signed by Tamara Ragsdale.
"Ms. Mattys [Ragsdale] is not admitted or licensed to practice law in Utah," Jeffs argues in the memorandum. "Nor is she party to this matter. As such her filing of an Answer for David Ragsdale ... constitutes an unauthorized practice of law."
The civil suit against David Ragsdale asks for a minimum of $1 million for his two sons because of the wrongful death of their mother. William Jeffs, guardian ad litem for the boys, said the power of attorney can be used for financial matters, like signing a check or selling property.
"Court's a different matter -- that's the real issue," he said. Jeffs said David Ragsdale will have to get an attorney to sign the response or sign it himself for it to be valid.
He said people with power of attorney have tried to sign court documents in the past, but the mistake is not very common.
It just goes to show one the mentality - more appropriately, the lack thereof - of this family! Good grief. I certainly wouldn't want Ragsdale's sister representing me if she can't figure out that she's not eligible to practice law in Utah!!!! (Funny thing is, he'd probably appeal any outcome of her representation based on imcompetent legal cousel!!!!! ) I hope the state will not preclude the death sentence in this case also!!!!!!

David is not a little kid, he does need anyone to speak for him. Sounds like they DO NOT want him to stand up for himself.
First, his sister says it was the drugs, then the doc's fault,he does not remember anything!!!! Now he is not capable of defending himself??????.....Sounds like they are going for diminished capacity defense!!!!!!!!!!!!
He DID PULL the trigger and then reloaded !!!!!!!! Yeah, I guess he did not WANT to remember anything after that.

I only hope all rights to the children remain with the wife's family. This family seems completely incapable of accepting responsibility for their actions.
