Lt. Governor's son to stand trial for assault

Nathan Herbert, a son of Lt. Gov. Gary Herbert, will stand trial Thursday for allegedly assaulting a Utah County woman.

The woman also has an ex parte stalking injunction against him.

The assault charge stems from an incident in July 2005 when the woman claims Herbert blocked her progress with his car while she and a friend were driving around Brigham Young University.

After asking the woman various questions, he got out of his car.

"The next thing I new [sic] I felt both of his hands around my neck and he was shaking me," the woman wrote.

After getting back in his car, Herbert allegedly told the woman's passenger, "Oh (she) and I go way back. I choke her all the time."

The simple assault charge is a Class B misdemeanor and carries a maximum sentence of six months in jail and a $1,000 fine. Calls to Herbert's attorney were not returned Thursday. Herbert's bench trial is in front of 4th District Judge Steven Hansen.
