Saratoga Springs Council members voted Tuesday night to overturn an ordinance that had prevented developers from building two different businesses under one roof in portions of the city.
The decision was a victory for Ivan Walker of Walker Oil who said that his company has tried for two years to open a combination gas station and Wendy's restaurant in the Gateway district. Walker said he would now submit plans for the store. Those plans must still be approved by planning commissioners and council members.
Councilwoman Mia B. Love was the only council member to vote against the change, saying Chevron had once approached the city with a similar idea and was told the concept was not allowed by city ordinances.
"I felt it was not fair to go back and change our development code," she said.
City attorney Tim Taylor said the city may change its ordinances at any time.
Other council members said they were not sure why the city had ever disallowed such combination-use stores.
"If indeed someone is willing to build something special there, if they are willing to branch out and make us a really good proposal on it, let's look at it," Councilwoman Marsha Paskett said.
