MILWAUKEE - A Wisconsin company that sells Off and Bug-Off insect repellent is alleging trademark infringement by a Utah company that sells Bug Off insect deterrent.
SC Johnson & Son Inc. filed a federal lawsuit in Milwaukee this week against Nutraceutical Corp. and its related entity, NutraMarks Inc.
Racine-based SC Johnson says it has used the Bug-Off trademark since as early as 1998. It says Nutraceutical is being deceptive by using a nearly identical product name that could confuse consumers.
A message left Wednesday with Nutraceutical in Park City, Utah, was not immediately returned.
SC Johnson is seeking damages in an amount to be determined, including $2 million for each trademarked item that Nutraceutical and NutraMarks allegedly infringed.
The lawsuit was filed Monday.
