AMENDED NOTICE

OF TRUSTEE’S SALE

The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States, in the West Foyer by the West Steps, Sanpete County Courthouse, 160 North Main, Manti, Utah, on January 11, 2011 at 10:00 a.m., for the purpose of foreclosing a Deed of Trust for Utah (“Trust Deed”) dated September 9, 2005 and originally executed by Royal I. Nelson and Janielle J. Nelson, as Trustor, in favor of the United States of America acting through the Rural Housing Service or successor agency, United States Department of Agriculture, as Beneficiary, covering the following real property located in Sanpete County, State of Utah:

Beginning at the Northwest corner of Lot 2, Block 32, Plat “B”, Moroni City Survey, Sanpete County, State of Utah; thence East 217.80 feet; thence South 104.25 feet; thence West 217.80 feet; thence North 104.25 feet to the point of beginning. Parcel No.: MERGEFIELD PropParcel 18989X2

The current beneficiary of the Trust Deed is United States of America acting through the Rural Housing Service or successor agency, United States Department of Agriculture and the record owner of the property as of the recording of the Notice of Default is Royal I. Nelson and Janielle J. Nelson.

Said sale will be made without any covenant or warranty, expressed or implied, pursuant to the power of sale conferred in the Trust Deed. The address is the property is reputed to be at 540 North 100 East, Moroni, Utah.

The opening bid will be the net recovery value of approximately $95,000.00, which is not a representation of the exact amount owed.

This Notice of Trustee’s Sale is an attempt to collect a debt, and any information obtained will be used for that purpose.

Bidders must tender to the trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale.

Both the deposit and the balance must be in the form of a wire transfer, cashier’s check or certified funds payable to Backman Title Services, Ltd.

Cash payments are not accepted.

This Notice amends and supersedes the Notice dated November 15, 2010.
