NOTICE OF

TRUSTEE’S SALE

The following described property will be sold at public auction to the highest bidder payable in lawful money of the United States at the time of sale at the Main Entrance of the Utah County District Court located at 125 North 100 West, Provo, UT 84601, on February 8, 2010, at 1:00 PM of said day for the purpose of foreclosing a Trust Deed originally executed on July 1, 1999 by Dan K. Shaw, as Trustee of the Dan K. Shaw Sole Property Trust, as trustor, in favor of Robert E. Clark and Ronald J. Clark, as Co-Trustees of the J. Sylvester Clark Trust, which beneficial interest was subsequently assigned to Arlington Investments, which subsequently assigned its beneficial interest in said Trust Deed to SVH Holdings, LLC, a Nevada Corporation, which subsequently assigned its beneficial interest in said Trust Deed to Cache Private Capital, LLC, a Utah Corporation, by and through that certain Assignment of Note and Trust Deed agreement dated September 21, 2009 and recorded on September 24, 2009 as Entry No. 102380:2009 in the Official Records of the County Recorder of Utah County, State of Utah, covering the following real property purported to be located in Utah County and more particularly described as:

Former Parcel No.: 30:073:0181 – 19.7000 ACRES BEGINNING at the South quarter corner of Section 22, Township 9 South, Range 2 East, Salt Lake Base and Meridian; THENCE, North 00°36’31” West partially along fence line 2599.03 feet; THENCE, South 89°10’12” East 97.16 feet; THENCE, South 49°22’12” East 92.30 feet; THENCE, South 29°47’33” East 334.99 feet; THENCE, South 00°37’10” East along a fence line 1438.43 feet; THENCE, South 00°35’52” West 805.82 feet; THENCE, South 89°33’35” West along the Section line 330.00 feet to THE POINT OF BEGINNING. INCLUDING the existing well thereon and the water rights represented by the following water right numbers: 51-4565 (A47203); 51-2961 (A3334i); 51-2884 (A25222a and A25222b).

SUBJECT TO the sole and exclusive right of RUBY R. CLARK to occupy the residence located on said property for her remaining lifetime; provided, however, that if she shall move from such residence, this right shall terminate at such time.

A Notice of Default was recorded on October 7, 2009, as Entry No. 106595:2009 in the official records of Utah County, State of Utah, whereby notice of default under the loan documents was properly given, all sums secured by the Trust Deed were declared immediately due and payable, and the election was made to cause the Property to be sold to satisfy the Loan. The current beneficiary of the Trust Deed is Cache Private Capital, LLC, a Utah Corporation, and the record owner of the property as of the recording of the Notice of Default is Dan K. Shaw.

Bidders must tender to the successor trustee a $25,000.00 deposit at the sale in order to participate in the sale, and the balance of the purchase price by 12:00 noon the day following the sale.
