Springville man arrested after allegedly firing gun near another man

A Springville man was arrested after police said he fired a gun near another man Sunday night.

Jose Rodriguez-Juarez, 39, was booked into the Utah County Jail and is being investigated on suspicion of nine separate offenses, including attempted murder, discharge of a firearm, possession of a controlled substance and public intoxication. Formal charges had not been filed as of Tuesday afternoon.

“According to statements gathered, Juarez made a statement indicating he was going to kill or hurt the victim. Juarez then entered the residence and returned with a handgun and fired a shot near the victim,” a police affidavit read. 

According to the affidavit, police responded to a reported argument in Springville and, upon arrival, saw Rodriguez-Juarez walking toward a vehicle to the west of the property. Police lost visual of Rodriguez-Juarez but then heard a gunshot from the direction he was walking, then saw him enter the home, court documents said. Police said Rodriguez-Juarez did not comply with the officers’ commands to exit the home, and SWAT responded and detained him.

Rodriguez-Juarez reportedly admitted to drinking before getting in a physical altercation with the victim. Per the affidavit, police believed he threatened the victim, entered the home, returned with a handgun and fired a shot near the victim.

Rodriguez-Juarez claimed that the victim fired a gun into the air during the fight, prompting him to retreat to the house out of fear, police said. After a search warrant was obtained, though, court reports said police found a handgun hidden under clothing inside the home, and that the ammunition was the same caliber and brand of spent casing on the driveway.

Police said they questioned Rodriguez-Juarez about the handgun.

“He responded that it was on a vehicle hood, so he took possession of it and ran it inside the house. That statement contradicted his prior statement that he had immediately run in the house after it was discharged. It also indicated he was attempting to hide the firearm used in the incident. Juarez made multiple statements that were found to be untrue,” the affidavit read.

A urine test found he had cocaine and ethyl glucuronide in his system, per court documents.

Police requested Rodriguez-Juarez be held without bail and said he is known to “frequently obstruct or attempt to obstruct justice.”
