An Orem man was sentenced to one year and one day in prison for his role in a fraudulent scheme, the United States Attorney’s Office District of Utah announced Monday.

Kole Glen Brimhall, 27, was involved in a fraudulent investment through Alpha Influence LLC, where he sold fake investment security contracts to over 135 investors, the attorney’s office said.

In addition to his prison time, Brimhall was sentenced to three years of supervised release and was ordered to pay $5,003,400 in restitution to the people he defrauded and a forfeiture money judgment of $1,097,709.82.

Brimhall pleaded guilty to fraud in November.

“Brimhall’s participation in defrauding investors not only left investors in financial devastation, but with a loss of trust that can have a lifelong impact in their personal and professional life,” said U.S. Attorney Felice John Viti in a statement. “It is our hope that by prosecuting these crimes, we will deter others from participating in affinity fraud schemes in our communities.”

In January, the ringleader of Alpha Influence, Jeremiah Joseph Evans, also pleaded guilty to degrading investors of over $20 million. He has yet to be sentenced for his crimes.

Per court documents, the schemers aggressively promoted through social media the idea that buying Alpha Influence investment would create “life-changing passive income” for investors. The attorney’s office said Brimhall received $1,097,709.82 in verifiable commissions from his 135 sales.
