CITY OF MT. PLEASANT

AMENDING ORDINANCE 2012-02

AN ORDINANCE ALTERING

CERTAIN MEETING TIMES

RECITALS:

WHEREAS, the city has changed the time of certain meetings and desires to change the city code to reflect the new times.

NOW THEREFORE, be it ordained by the City Council of Mt. Pleasant City, Utah:

I) Mt. Pleasant City Code Section 2-2-2 establishing meeting times for the Planning Commission shall be modified as follows:

. . . The planning commission shall conduct one regular meeting, which shall be held on the third Tuesday of each month at the Mt. Pleasant City Hall, 115 West Main Street, which meeting shall begin promptly at Twelve Noon during Mountain Time.

II) Mt. Pleasant City Code Section 1-6-5(A) establishing meeting times for the city council shall be modified as follows:

. . . The governing body shall conduct one (1) regular meeting, which shall be held on the second Tuesday of each month at the Mt. Pleasant City Hall, 115 West Main Street, which meetings shall begin promptly at seven thirty o’clock (7:30) P.M. during Mountain Time, but if the meeting date is a legal holiday, then the meeting shall be held at the same time and place above described on the day next following that is not a legal holiday. The governing body shall also conduct a second shorter meeting every month, which shall be held on the fourth Tuesday of each month at Mt. Pleasant City Hall, 115 West Main Street, which meetings shall begin promptly at four o’clock (4:00) P.M. during Mountain Time, but if the meeting date is a legal holiday, then the meeting shall be held at the same time and place above described on the day next following that is not a legal holiday. It is intended this shorter meeting shall only be used to approve claims and matters that cannot reasonably wait until the next meeting, but any agenda matter may be heard at this meeting that could be heard during a regular meeting.

3) Mt. Pleasant City Code 1-6-5(D) shall be re-numbered 1-6-5(E), and all the following portions of 1-6-5 shall be similarly re-numbered so as to allow a new 1-6-5(D) to be added, which shall read:

III) Electronic Meetings: Electronic meetings shall be permitted in accordance with the provisions of Utah Code Annotated title 52, chapter 4, section 207, or any successor ordinance. Electronic meetings are permitted in the least restrictive manner permitted under Utah Code.

4) Repeal of Conflicting Ordinances: To the extent that any ordinances, resolutions, or policies of the City of Mt. Pleasant conflict with provisions of this ordinance, they are hereby amended.
