Case closed: The civil case against BYU QB Jake Retzlaff dismissed by judge

The civil case accusing Jake Retzlaff of sexual assault was dismissed by a 3rd District Court judge on Monday just days after the BYU quarterback’s attorneys issued a point-by-point response to the civil charges that were brought back on May 21.

Judge Coral Sanchez signed off on the dismissal that was agreed upon by attorneys from both parties, effectively ending the case in its entirety. The dismissal was made with prejudice, as agreed upon by Terence L. Rooney, who represented the plaintiff, and Stephen R. Waldron, who represented Retzlaff, which means it cannot be refiled in a court of law.

Waldron issued a vigorous defense of Retzlaff in his response filed on Friday to the sexual assault allegations, stating, “Mr. Retzlaff specifically and categorically denies each and every and all allegations that he bit, raped or strangled AG (the plaintiff), which are ridiculous and bizarre allegations, all of which are false and untrue.”

Retzlaff did admit to a consensual encounter, however, with Waldron stating, “Instead, Mr. Retzlaff and AG had a pleasant and entirely consensual evening together, playing video games, and a normal evening of consensual sexual interaction that was uneventful but pleasant, with the plaintiff sleeping over and leaving the next morning to return to Salt Lake City.”

Although Retzlaff avoided the civil suit in the matter, BYU chose to move forward with a reported seven-game suspension due to Retzlaff admitting to engaging in sexual conduct with the plaintiff, which is a violation of the school’s honor code. Retzlaff will likely transfer out of the program in lieu of playing just a mere five games this coming season, as a result.

Retzlaff was set to start for BYU this coming season after accumulating 2,947 yards passing and 20 touchdowns last season. The former Riverside College transfer also rushed for 417 yards and another six touchdowns while leading the Cougars to an 11-2 overall record and a 36-14 win over Colorado in the Alamo Bowl.
