A vehicle was found upside down in a Cedar Valley horse stable after crashing Tuesday, May 3, 2022. Two 3-year-olds were killed in the crash. The families of two toddlers killed after being hit by a car while playing in a horse corral in Eagle Mountain in 2022 will have to wait even longer for closure.
Kent Cody Barlow, the man accused of causing the boys’ deaths, is charged with two counts of first-degree murder and one count of drug possession.
On May 2, 2022, Odin Ratliff and Hunter Jackson — both 3 years old at the time — were playing together with toy trucks inside the stable when they were struck by a vehicle.
Barlow is accused of traveling at speeds near 100 mph and having methamphetamines in his system at the time of the crash.
More than two years later, his trial, which has faced numerous delays, just hit another roadblock.
During a hearing Monday, the judge presiding over the case ruled that a new judge will be appointed to take over, according to Fox 13.
Last month, Utah County public defender Benjamin Aldana filed a motion to withdraw from the case following the death of his father in July. Judge Robert Lund initially rejected the motion. But on Sept. 13, the Utah Supreme Court overruled Lund’s denial and allowed Aldana to leave the case, three days before the trial was set to begin, KUTV reported.
The high court said its decision shouldn’t require further delay of moving the case along, but Barlow’s new attorney told the judge Monday that he’s not prepared to proceed. He said the earliest he’d be ready is next March.
Along with the change in counsel, Lund is set to retire at the end of the year.
“What’s going to happen now is this case is going to be reassigned to another judge, because it can’t be tried before the end of the year,” Lund said during the hearing.
He also apologized to the families of Odin and Hunter that a resolution in the case is being put off once again.
“I extend my sincere apologies to the families of the victims, because their right to a speedy trial is one of the considerations that the court took into account in trying to get this case to trial this week,” Lund said.
The defense and prosecution teams will have to meet with the new judge once one is assigned to determine when the trial could pick back up in 2025.
