At a pretrial hearing Tuesday where Rossi appeared virtually from the Utah County Jail before 4th District Judge Derek Pullan, his attorneys and prosecutors said they were unable to reach a plea deal in a 2008 case of an alleged rape out of Orem.
“The state withdrew any plea offerings, with the understanding that it will not be offered again,” Deputy Utah County Attorney Stephen Jones told the judge.
Last month, the state offered Rossi a plea deal in the case, though exact conditions of what it would entail were not revealed at the time, KSL TV reported.
During a hearing Dec. 17, the deadline Rossi was given to either accept or reject the deal, his defense attorney told the judge that the state had agreed to give his client more time to consider the deal.
KSL TV also reported that Pullan seemingly became agitated due to Rossi’s failure to appear on camera at the December conference.
However, on Tuesday, Rossi was shown on the remote cameras in a wheelchair wearing an oxygen mask and holding an oxygen tank.
Rossi, whose legal name is Nicholas Alahverdian, but who also goes by Arthur Knight, is accused of sexually assaulting a 21-year-old woman in Orem in 2008. He also is accused in another alleged rape case out of Salt Lake County from that same year.
At an October hearing, Rossi claimed that he’s undergone the numerous name changes due to prior threats made on his life.
A motion in the Utah County case will be heard in March, at which Pullan has ordered Rossi to appear in person.
The trial is tentatively set to begin in September.
