Boy to be tried as adult in Fun Dome shooting case

By Daily Herald - | Apr 27, 2003

SALT LAKE CITY (AP) — A 16-year-old boy accused of attempted murder for last month’s shooting at a popular Murray amusement center will stand trial as an adult.

After a preliminary hearing that lasted more than three hours, Juvenile Court Judge Robert S. Yeates on Friday bound over David Van on four second-degree felony counts of attempted murder in the March 29 shooting at the Utah Fun Dome.

Four people were injured, including a 4-year-old boy who was shot in the groin area. All are recovering.

Van also was bound over on four third-degree felony counts of discharging a firearm from a vehicle near a highway or in the direction of a person, building or vehicle, and one count of obstruction of justice. If convicted, he could face a sentence of up to 15 years in prison.

The shooting apparently followed an argument between 15-year-old Bruce Bouthviset and 16-year-old Librado Guzman. Bouthviset testified Friday that Guzman accused him of flashing gang signs at him the day before, but he denied he had done so.

Bouthviset, who testified he knew Van was carrying a gun that night, said he suggested the youths take the disagreement outside.

“We thought they were going to fight with us, just like a normal fight,” Guzman testified through an interpreter.

He said Van pulled out a gun and started firing “towards the people” as patrons began “yelling and screaming.”

Murray police said after the shooting they found at least 17 shell casings in the parking lot.
